Terms of service

These terms apply to the use of Plek, the online booking platform operated by Small Victories, Mellestraat 303, 9090 Merelbeke-Melle, enterprise number BE0793.301.929 ("Plek", "we", "us"). By creating an account or making a booking through Plek, you accept these terms.

What Plek is

Plek is software that organisations (studios, clubs, schools and others) use to offer their activities online and to manage bookings, participants, attendance and payments. Plek itself does not organise any activity.

Accounts

  • You provide correct information and keep it up to date.
  • You keep your sign-in details secret and tell us or the organisation if you think someone else has access to your account. You are responsible for what happens through your account.
  • A customer account belongs to one organisation. Customer accounts are meant for adults; a parent or guardian books for children.
  • Staff accounts are personal. The organisation decides who gets access and with which role, and is responsible for what its staff do in Plek.

Bookings are an agreement with the organisation

When you book a session, series, pass, subscription or gift card, you enter into an agreement with the organisation that offers it, not with Plek. The organisation sets the content, prices, capacity, cancellation and refund rules and its own terms and conditions, which you accept when booking. Questions or complaints about an activity, a booking or a refund go to the organisation.

Payments

Online payments are handled by payment providers chosen by the organisation (such as Mollie, Worldline or Payconiq), under their own terms. The money goes to the organisation. Plek does not receive or store your card or bank details. Refunds follow the organisation's rules and are made by the organisation.

Acceptable use

You may not:

  • break the law or the rights of others through Plek, or use it to send spam or unlawful content;
  • try to access accounts, data or organisations that are not yours, or get around security or access rules;
  • disrupt or overload the service, or scrape, copy or resell it without our permission;
  • upload viruses or other harmful code.

We may suspend or close an account that breaks these rules, where possible after a warning.

Organisations

An organisation that uses Plek is the controller of its customers' and participants' personal data and is responsible for having a legal basis for what it asks and for its own terms, prices and communication. Plek processes that data on its behalf under a data processing agreement. The commercial terms between Plek and an organisation (price, term, support) are agreed separately.

Availability and changes

We do our best to keep Plek available and secure, but we cannot guarantee that it is always available or free of errors. We may improve or change Plek; if a change takes away something important, we tell organisations in advance.

Intellectual property

Plek, its software and its design belong to us. Organisations keep the rights to their own content (texts, images, logos) and give us permission to use it only to provide the service.

Liability

Plek is responsible for providing the platform, not for the activities organisations offer or for how they carry out bookings. To the extent permitted by law, we are not liable for indirect damage such as lost profit or lost data, and our liability towards an organisation is limited to the amounts it paid us in the twelve months before the damage. Nothing in these terms limits liability for intent, gross negligence, death or personal injury, or your rights as a consumer that cannot be excluded by law.

How we handle personal data is described in our privacy policy.

Ending

You can stop using Plek at any time and ask for your account to be deleted from the customer portal or through the organisation. Bookings you already made remain an agreement with the organisation.

Changes to these terms

We may change these terms. The date at the top shows the latest version. We announce important changes in advance; if you keep using Plek after they take effect, you accept the new terms.

Applicable law and disputes

These terms are governed by Belgian law. Disputes are brought before the competent courts of the judicial district of the registered office of Small Victories, unless the law gives you as a consumer the right to go to the court where you live. Consumers can also use the Consumer Ombudsman Service.
